1. Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and ListCrawler (“ListCrawler,” “we,” “us,” “our”) governing your access to and use of listcrawler1.vercel.app and any related services (the “Service”).

By accessing or using the Service, you agree to these Terms, our Privacy Policy, and our DMCA Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least eighteen (18) years of age (or the age of legal majority in your jurisdiction, whichever is older) to access the Service. By using the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into these Terms;
• It is lawful for you to access adult content in your jurisdiction;
• You are not accessing the Service on behalf of a minor; and
• You are not located in a jurisdiction where the Service is prohibited.

If you are under 18 or do not meet these requirements, you must leave the Service immediately.

3. The Service

ListCrawler is a directory and aggregator of adult classified listings publicly posted on independent third-party platforms. The Service indexes these listings, organizes them by city and category, and links back to their original sources.

ListCrawler does not:

• Create, author, or host the original content of the listings;
• Verify the identity, age, truthfulness, or claims of any poster;
• Endorse, vouch for, or guarantee any listing or poster;
• Act as an agent, broker, or intermediary between posters and visitors;
• Process payments or handle money between posters and visitors.

All interactions between you and any person, listing, or third-party site are solely between you and that party, at your own risk.

4. User Conduct

When using the Service, you agree not to:

• Use the Service for any purpose that is unlawful or prohibited by these Terms;
• Use the Service to engage in or facilitate human trafficking, sexual exploitation, or any other criminal activity;
• Attempt to access, view, or distribute content involving any person under 18;
• Harass, threaten, stalk, or defraud any person you contact through a listing;
• Attempt to gain unauthorized access to the Service, our infrastructure, or other users’ data;
• Scrape, crawl, or otherwise systematically extract content from the Service except as expressly permitted;
• Interfere with or disrupt the Service, including by deploying malware, DDoS traffic, or exploit attempts;
• Use the Service to distribute spam, malware, or deceptive content;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Circumvent any access controls, rate limits, or security measures.

Violations may result in removal of listings, restriction of access, or referral to law enforcement.

5. Third-Party Content

The Service indexes listings created by third parties and links to external websites. ListCrawler does not control and is not responsible for the content, accuracy, privacy practices, or availability of third-party listings, websites, or services.

Your dealings with any third party — including any poster, advertiser, or linked site — are solely between you and that party. ListCrawler is not a party to any such dealing and disclaims all responsibility for the outcome.

6. Intellectual Property

The ListCrawler name, logo, site design, code, and the organization and arrangement of the directory are owned by ListCrawler or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms. No other license or right is granted.

Listings and associated content are the property of their respective original creators or the platforms that host them. Copyright concerns relating to aggregated content should be directed to our Designated Copyright Agent.

7. Disclaimers

Without limiting the foregoing, ListCrawler does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free;
• Any information obtained through the Service will be accurate, reliable, or complete;
• Any listing or poster is genuine, truthful, safe, or legal;
• Any defects in the Service will be corrected.

You assume all risk associated with using the Service and interacting with any listing, poster, or third-party site. Any content you download or access through the Service is at your own risk.

8. Limitation of Liability

This includes damages arising from:

• Your interactions with any third party, listing, or external site;
• Any content, whether aggregated from third parties or otherwise;
• Unauthorized access to your devices, accounts, or data;
• Any bugs, viruses, or harmful components transmitted through the Service;
• Any physical, emotional, financial, or other harm resulting from a meeting or interaction arranged through a listing.

To the extent a court finds liability despite the above, ListCrawler’s total aggregate liability to you for all claims arising out of or relating to the Service is limited to one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless ListCrawler, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• Your use of the Service;
• Your violation of these Terms;
• Your violation of any rights of a third party, including any poster or person you interact with;
• Your violation of any applicable law or regulation.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including for violation of these Terms. You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law & Disputes.

11. Governing Law & Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict of laws principles. To the extent not required to be arbitrated under Section 12, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any disputes arising out of or relating to these Terms or the Service.

12. Arbitration & Class Waiver

Please read this section carefully. It affects your legal rights.

12.1 Agreement to arbitrate

You and ListCrawler agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

12.2 Exceptions

This arbitration agreement does not apply to: (a) claims for intellectual property infringement; (b) claims that may be brought in small claims court if they qualify for that forum; or (c) any injunctive relief necessary to stop unauthorized use of the Service.

You may opt out of this arbitration agreement by sending written notice to legal@listcrawler1.vercel.app within 30 days of first accepting these Terms. Your opt-out notice must include your name and a statement that you decline to arbitrate.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date at the top of this page and, where appropriate, by a notice on the site. Continued use of the Service after a change constitutes acceptance of the updated Terms.

14. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy, DMCA Policy, and 2257 Statement, constitute the entire agreement between you and ListCrawler concerning the Service.

Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.

Headings. Section headings are for convenience only and do not affect interpretation.
